1. General Terms

The website www.forya.ae (referred to as the "Site" or “Website”) is an online platform accessible through the Internet at the aforementioned address. It is open to all users of the Internet (referred to as "Users"). The Site is operated by Forya Trading LLC (referred to as "we," "the Company," or "the Vendor"). Through the Site, the Company offers various products (referred to as the "Products") for sale to Users. These Terms of Service establish the relationship between Users and the Company, collectively referred to as the "Parties," and individually as a "Party." A User who places an order becomes a "Customer."

By accessing and using the Site, Users agree to abide by these terms and conditions. The Company reserves the right to amend these Terms of Service without prior notice. Any changes will not affect orders already accepted and confirmed by Customers. The updated terms will be effective upon publication on the Site.

(i) The rights and responsibilities of Users automatically extend to Customers.

(ii) Placing an order for Products on the Site signifies the Customer's explicit acceptance of these Terms of Service.

(iii) Users are not permitted to alter these Terms of Service but may create a backup copy or print them for reference.

(iv) These Terms of Service supersede any other documents.

2. Registration and Account Security

There is no option for an account registration at the moment.

3. Products Available for Purchase

The Company exclusively presents the items for sale on the Site.

All product offerings including any special promotions remain valid as long as they are displayed on the Site.

4. Prices of Saleable Products on the site

The prices of all listed Products are in United Arab Emirates Dirham (AED) and are charged at the prevailing rate upon order acceptance.

5. Placing Orders

When placing an order, the Customer fully accepts and acknowledges these General Terms of Sale without reservation. The Company's order registration system serves as conclusive evidence of the order and its timing. By clicking the "Submit Order" or “Place Order” or “Confirm Order” button, the Customer asserts their agreement to these General Terms of Sale. A summary of the order can be printed for reference.

Upon registration of the order by the Company, a comprehensive acknowledgment of the order can be dispatched to the Customer's provided email address upon request. This acknowledgment confirms the transaction, contingent upon product availability and order payment. Should any ordered Products be unavailable, the Customer will receive notification via email. In such cases, the order amount will be recalculated, with the price of the unavailable Products deducted. If the entire order becomes unavailable, it will be canceled, and the Customer will be duly informed via email with no charges incurred.

6. Method of Payment:

The Company accepts Cash on Delivery (COD), credit and debit cards as the payment method for orders. No other forms of payment are accepted for orders, we reserve the right to exclude particular methods of payment.

For credit and debit cards payments, If the issuer of the Customer’s credit card declines authorization for payment to the Company, delivery will be postponed and the Customer will be contacted. The Company bears no responsibility for delays or non-delivery in such cases.

Credit cards used for purchases must be valid and registered under the Customer’s name. The Company assumes no liability for credit card fraud. All payment methods require the Customer to settle payment prior to delivery

Orders must be paid in United Arab Emirates Dirham (AED).

The Company reserves the right to modify payment terms for any order without prior notice, and to adjust payment methods for Products offered online through announcements on the website, via email, or other public communications.

The Customer warrants that they have obtained any necessary authorizations for their chosen payment method when placing an order. In the event of non-payment or adverse payment circumstances, the Company reserves the right to suspend or cancel any order or delivery regardless of their status or nature.

7. Payment Timing

Payment for Cash on Delivery (COD) orders is due upon delivery of the Products to the Customer's specified address. The Customer is required to provide the exact amount in cash to the delivery personnel upon receipt of the order.

8. Order Confirmation

Placing an order using the Cash on Delivery (COD) or online payment method constitutes the Customer's agreement to these General Terms of Sale.

9. Order Verification

Upon placing a Cash on Delivery (COD) or online order, the Customer acknowledges that the Company reserves the right to verify the authenticity of the order and the availability of the Products before processing and dispatching the order for delivery.

10. Payment Responsibility

By selecting the Cash on Delivery (COD)  payment method, the Customer agrees to fulfill the payment obligation upon receipt of the ordered Products. Failure to provide the exact amount in cash at the time of delivery may result in the cancellation of the order.

11. Order Cancellation

In the event that the Customer refuses to accept or pay for the delivered Products during Cash on Delivery (COD)  delivery, the Company reserves the right to cancel the order and may impose additional charges or restrictions on future Cash on Delivery (COD)  orders placed by the same Customer.

12. Non-Payment Consequences

Failure to fulfill the payment obligation for a Cash on Delivery (COD)  order may result in the Customer being restricted from using the Cash on Delivery (COD)  payment method for future orders, and the Company reserves the right to take legal action to recover any outstanding payments.

13. Customer Agreement

By proceeding with a Cash on Delivery (COD) or online order, the Customer acknowledges and agrees to abide by these General Terms of Sale for COD payments.

14. Delivery Process

Products will be dispatched via courier to the address specified by the Customer during order placement. Estimated delivery dates are contingent upon payment confirmation and stock availability. However, any estimated delivery date may be subject to change due to operational or unforeseen circumstances, such as system errors. In such instances, the Company will communicate with the Customer to reschedule delivery arrangements.

Delivery charges are as follows:

• Order Amount 650 AED or above: Free
• Order Amount below 650 AED: Additional 30 AED payment shall be charged upon Delivery

Delivery is facilitated to different Emirates, excluding specified areas. The Company's determination of these areas is final. Deliveries are made to both commercial and residential addresses. P.O. boxes and logistics centers are not accepted as delivery addresses. Each order can only be delivered to one address; for multiple addresses, separate orders must be placed.

15. Returns and Refunds

All Products are deemed non-returnable and non-refundable.

16. Product Exchange

In the event of damaged, defective, or incorrectly delivered Products, the Customer must notify the Company’s Customer Services via email at info@forya.ae within one (1) day of the delivery date. Returned Products must be unopened, in their original packaging and include all accessories and inserts. 

Products must be returned prepaid. Shipping costs are non-refundable.

Upon confirmation of the Customer’s eligibility for an exchange, the Company will dispatch replacement items at no additional cost, provided the original Products are returned in their original condition within ten (10) business days from the delivery date or from the discovery of the defect.

17. Return Instructions

Customers must attach photos of the returned Products as evidence when contacting Customer Services. Upon acceptance of the case by Customer Services, Customers must send the Products back for verification. Regardless of the reason for returning Products, Customers must contact the Company at info@forya.ae for instructions and adhere to the provided instructions to facilitate processing. Any risks associated with returning Products are borne by the Customer.

Non-Returnable Products

Products cannot be exchanged under the following circumstances:

• Products not included in an order.
• Products purchased or delivered more than one (1) day prior.
• Related Products for exchange are not returned by the Customer.
• Gifts, trial packs, or samples.
• Product packaging is not damaged or intact.
• Product rejection based on personal preference.
• In case of disputes, the Company reserves the right to make the final decision.

18. Force Majeure

The Company shall not be liable for failure to perform services due to circumstances beyond its control, including acts of God, natural disasters, labor disputes, shortages, or unavailability of products or materials, or other causes deemed reasonable by the Company.

19. Liability

The Company disclaims all liability for any loss, damage, or expense incurred by Customers directly or indirectly resulting from their access and use of the website and its content. Except for special price offers, the Company cannot be held liable for order fulfillment failures due to stock shortages or product unavailability resulting from force majeure events. The Company assumes no responsibility for interruptions to the site, bugs, fraudulent intrusions, or any direct or indirect damages resulting from accessing or being unable to access the site.

20. Intellectual Property

The Company retains exclusive ownership of the Site and all its elements, including but not limited to brands, designs, photographs, texts, logos, graphics, etc. Unauthorized reproduction or use of any content or brands on the Site is strictly prohibited without prior written consent from the Company. Any other use constitutes infringement.​
